These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relationship between:

(hereinafter “Ian WOOD – Société Kayak la Baie”)
and any natural or legal person (hereinafter "the Client") wishing to book one or more services offered by Ian WOOD - Société Kayak la Baie.
Object
These General Terms and Conditions of Sale (GTC) define the conditions under which Ian WOOD - Société Kayak la Baie offers and sells leisure and tourism activities, including outings, events or experiences, to:
private individuals,
professionals
established groups (associations, companies, communities, etc.).
Booking conditions
Booking with Ian Wood - Kayak la Baie is mandatory for all activities. The client makes their booking, choosing from the following options:

For groups and professionals, a quote can be provided. The reservation is confirmed upon receipt of the signed quote bearing the words "approved".
For groups of 10 or more people: A 25% deposit will be required upon booking.
For individuals: payment must be made on the day of the service. The client must bring a means of payment – check or cash. If payment is not made on site, Ian WOOD - Kayak la Baie reserves the right to refuse the service.

Modifications and cancellations of reservations
Modifications by the Client
No quantitative or qualitative modification of reservation can be accepted except with the prior agreement of Ian WOOD - Kayak la Baie.
Requests to modify a reservation must be made only to: Ian WOOD - Kayak la Baie either by email kayaklabaie@orange.fr or by phone at 06.08.77.04.37 specifying the name of the Client, the service concerned and the date.
Requests for changes are accepted up to 24 hours before the scheduled service date. Otherwise, Ian WOOD - Kayak la Baie will not consider the request. Changes made by Ian WOOD - Kayak la Baie are subject to availability and the circumstances at that time of year.
When a modification results in a price increase (different services, a higher number of participants, etc.), the additional amount is included directly in the invoice from Ian WOOD - Kayak la Baie. These additional charges will be payable on the day of the service.
Cancellation by the Customer
The Client has the option to cancel their services and must inform Ian WOOD - Kayak la Baie beforehand by email at the following address: kayaklabaie@orange.fr or by telephone at: 06.08.77.04.37
Cancellations of services by the Client are subject to the following conditions:
In case of cancellation more than 7 days before the scheduled date of the service: the Client will not bear any cancellation fees and will be fully reimbursed by Ian WOOD - Kayak la Baie for any sums paid.
In the event of cancellation between 7 days and 24 hours before the scheduled service: Ian WOOD - Kayak la Baie will charge a cancellation fee of 25% of the total price (including VAT) of the cancelled service. The remaining balance will be refunded to the Client by Ian WOOD - Kayak la Baie as soon as possible.
In case of cancellation less than 24 hours before the scheduled service: the cancellation will be subject to full billing by Ian WOOD - Kayak la Baie. Therefore, no refund will be issued for any payments made.
If the Client does not show up at the agreed dates and times without informing Ian WOOD - Kayak la Baie beforehand under the aforementioned conditions, any sums paid by the latter for his reservation will be definitively lost.
However, if exceptional and unavoidable circumstances occurring at the destination or in its immediate vicinity have significant consequences on the performance of the services, the Client may cancel their service and is entitled to a full refund of payments made but not to additional compensation.
Modifications and/or cancellations by Ian WOOD - Kayak la Baie
If safety conditions prove insufficient due to adverse weather conditions (storm, strong winds, fog, storm, orange alert from Météo France, etc.) and/or due to a significant rise in water level (high tides, water release, storm, etc.), Ian Wood - Kayak la Baie may be forced to cancel the services booked, such circumstances being considered exceptional and unavoidable.
Ian Wood - Kayak la Baie reserves the right to cancel the service at any time and without prior notice, including on the day of the service, which the Client acknowledges and accepts. In any event, Ian Wood - Kayak la Baie will inform the Client as soon as possible.
When Ian Wood - Kayak la Baie cancels the service under these conditions, the Client is entitled to a full refund of any sums paid, but to no additional compensation.
If Ian Wood - Kayak la Baie is forced to modify an essential element of the service, the Client has the option to either cancel their booking and receive a refund, or accept the proposed modification. The Client must then communicate their choice as soon as possible. When deciding to cancel the booking, the Client is entitled, without penalty or charge, to a full refund of any sums paid.
After departure, if the safety conditions of the Clients require it, Ian Wood - Kayak la Baie may adapt and/or modify the route and/or the duration of the service initially planned without compensation to the Client.
Customer Obligations
The Client agrees to provide Ian WOOD - Kayak la Baie with all the information necessary for the proper execution of the services. In this regard, the Client remains responsible for the content and accuracy of the information they provide to Ian WOOD - Kayak la Baie.
The Client must in any case inform Ian WOOD - Kayak la Baie, in writing or by telephone and prior to any booking, of any particularity concerning him/her which may affect the course of the service (persons with reduced mobility with or without a wheelchair, presence of an animal, etc.).
The Client is further informed that the services correspond to activities carried out outdoors and are therefore exposed to climatic hazards (rain, wind, cold, sun, sea water, etc.).
Ian WOOD - Kayak la Baie provides the necessary equipment and gear for customer safety. It is the customer's responsibility to bring clothing and equipment appropriate for the nature of the booked services, including warm clothing, rain gear, hats, sunglasses, sunscreen, water bottles, etc.
Furthermore, the Client is informed that the services consist primarily of walks and hikes, kayaking or paddleboarding excursions, with the duration and difficulty varying depending on the chosen route. These services therefore require a minimum level of physical fitness.
Depending on the circumstances, Ian WOOD - Kayak la Baie may ask a Client not to continue the service if the latter does not appear to be physically able to complete it.
The Client must arrive at the scheduled dates and locations. As meeting points vary depending on the services and route chosen by the Client, they must stay informed of the necessary details by contacting Ian Wood - Kayak la Baie.
In the event of a delay by the Client, Ian WOOD - Kayak la Baie will begin the service with the other Clients present, the late Client cannot claim any refund and/or compensation on this basis.
The Client is prohibited from arriving at the meeting point under the influence of alcohol and/or narcotics. Failure to comply may result in Ian WOOD - Kayak la Baie refusing the service to the Client in question, without the latter being entitled to any refund or compensation. Furthermore, the consumption of alcohol and/or narcotics during the service is prohibited.
Responsibilities
The duration of the services and return times are provided for informational purposes only, as they may vary depending on factors such as weather conditions and the participants (number, physical abilities, etc.). Consequently, Ian WOOD - Kayak la Baie cannot be held liable if the duration of the services and return times do not exactly match the duration and times previously indicated to the Client.
It is specified that the services correspond to seaside activities and are subject to weather conditions, which may delay or even prevent the provision of services. In any event, Ian WOOD - Kayak la Baie cannot be held liable for any delay and/or prevention due to exceptional and unavoidable circumstances, force majeure, or the fault of the Client or a third party.
Ian WOOD - Kayak la Baie reserves the right, as an independent company, to subcontract all or part of its services.
Ian WOOD - Kayak la Baie undertakes to provide the services defined in the booking, in accordance with applicable standards and regulations. However, Ian WOOD - Kayak la Baie cannot be held responsible for the services chosen by the Client.
Ian WOOD - Kayak la Baie cannot be held responsible for any forgotten, lost or stolen personal belongings left on board boats, minibuses or in any other location and cannot guarantee their return.
In the event of exceptional and unavoidable circumstances and/or an event of force majeure, fortuitous event or external cause, in particular due to adverse weather conditions and/or significant rises in water levels preventing the performance of services, fires, floods, total or partial strikes, travel disruptions, thefts, changes in regulations, disruptions in energy supply, malfunction or interruption of electrical or telecommunications networks, accidental breakage… Ian WOOD - Kayak la Baie will be automatically released and without compensation from its obligation to perform the service and from its liability from the date of occurrence of the events until their end.
Insurance
Ian WOOD - Kayak la Baie has taken out a Professional Civil Liability insurance contract with GROUPAMA, Sartilly Agency, 56 Grande rue, 50530 SARTILLY BAIE BOCAGE (contract no. 609199860001).
Personal data
The personal data collected is used solely for the purpose of managing reservations and customer relations.
In accordance with current regulations (GDPR), the Customer has the right to access, rectify and delete their data by contacting: kayaklabaie@orange.fr.
Intellectual property
All content on this site (texts, images, logos, videos) is the exclusive property of Ian WOOD - Kayak la Baie and may not be used without prior authorization.
